1. Introduction
These Terms and Conditions ("Terms") govern the relationship between you ("User", "Customer", or "you") and Flyahoy ("we", "us", or "our"), a company registered and operating in Portugal, in connection with the use of our website, mobile application, and eSIM services (collectively, the "Services").
By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy. If you do not agree with any provision of these Terms, you must discontinue use of our Services immediately.
We reserve the right to amend these Terms at any time. Any changes will be published on this page with an updated effective date. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.

2. Definitions
- "eSIM" means an embedded SIM (Subscriber Identity Module) that is digitally provisioned onto a compatible device, enabling mobile data connectivity without a physical SIM card.
- "Data Plan" means a prepaid mobile data package purchased through our platform for use via eSIM technology.
- "Account" means the personal user account created on our platform to access and manage Services.
- "Platform" means the Flyahoy website (flyahoy.com), mobile application, and any related digital interfaces.
- "Network Partner" means any third-party mobile network operator through which we deliver connectivity services.
3. Eligibility and Account Registration
To use our Services, you must:
- Be at least 18 years of age or have the legal capacity to enter into a binding agreement in your jurisdiction;
- Possess a device compatible with eSIM technology;
- Provide accurate, complete, and current information during registration;
- Maintain the confidentiality of your account credentials.
You are solely responsible for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorized use of your account or any breach of security.
We reserve the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or are used for fraudulent purposes.
4. Services and eSIM Activation
Flyahoy provides prepaid mobile data connectivity through eSIM technology. Our Services include:
- The sale and digital delivery of eSIM data plans for use in supported countries and regions;
- Account management tools for purchasing, installing, and monitoring data usage;
- Customer support via email, live chat, and in-app assistance.
4.1 eSIM Installation and Activation
Upon successful purchase, you will receive an eSIM profile (via QR code or direct installation). The eSIM must be installed on a compatible, unlocked device. Activation occurs when the eSIM connects to a supported network in the destination country.
4.2 Service Availability
While we strive to ensure uninterrupted service, connectivity depends on the infrastructure and coverage of our Network Partners. We do not guarantee specific speeds, uninterrupted service, or coverage in all areas within a supported country. Network performance may vary due to factors beyond our control, including but not limited to geography, network congestion, weather conditions, and local regulations.
5. Pricing, Payment, and Billing
5.1 Pricing
All prices displayed on our Platform are inclusive of applicable taxes unless otherwise stated. Prices are quoted in the currency selected by the User and may vary depending on the data plan, destination, and duration.
5.2 Payment
We accept payment via credit card, debit card, and other payment methods made available on our Platform. All transactions are processed through secure, PCI-DSS compliant third-party payment processors. Flyahoy does not store your full payment card details.
5.3 Order Confirmation
Upon successful payment, you will receive an order confirmation via email containing your eSIM installation details. The contract of sale is formed at the moment of order confirmation.
5.4 Failed Payments
If a payment fails or is declined, the order will not be processed. We are not responsible for any fees or charges imposed by your financial institution in connection with failed or declined transactions.
6. User Obligations and Acceptable Use
By using our Services, you agree to:
- Use the Services solely for lawful, personal purposes;
- Not resell, redistribute, or commercially exploit our eSIM products or data plans without prior written authorization;
- Not attempt to reverse-engineer, decompile, or tamper with our Platform or eSIM technology;
- Not use our Services to transmit malware, spam, or any content that is illegal, harmful, threatening, abusive, or otherwise objectionable;
- Not use our Services in any manner that could damage, disable, or impair our systems or interfere with other users' access;
- Comply with all applicable local, national, and international laws and regulations when using our Services.
Violation of these obligations may result in immediate suspension or termination of your account and access to Services, without prejudice to our right to pursue legal remedies.
7. Intellectual Property
All content, materials, trademarks, logos, software, and technology available on or through our Platform are the exclusive property of Flyahoy or its licensors and are protected by Portuguese, European, and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and Services for personal, non-commercial purposes only. You may not:
- Copy, reproduce, modify, or distribute any content from our Platform;
- Use our trademarks or branding without express written consent;
- Create derivative works based on our Platform or Services.
8. Limitation of Liability
To the maximum extent permitted by applicable law, including Portuguese and European Union consumer protection legislation:
- Flyahoy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or in connection with the use or inability to use our Services;
- Our total aggregate liability for any claim arising under these Terms shall not exceed the amount paid by you for the specific Service giving rise to such claim;
- We are not liable for any loss of data, revenue, business opportunities, or any damages resulting from service interruptions caused by Network Partners, force majeure events, or circumstances beyond our reasonable control.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Portuguese Republic, without regard to its conflict of law provisions.
In accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council, consumers residing in the European Union may submit disputes to the Online Dispute Resolution (ODR) platform available at https://ec.europa.eu/consumers/odr.
Any disputes that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of Lisbon, Portugal, without prejudice to any mandatory consumer protection provisions that may apply in your country of residence.
10. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect.
